HOMEFREE ONLINE BANKING SERVICE AGREEMENT & TERMS AND CONDITIONS              

The following user agreement governs the use of your HomeFree Online banking services.  By using the HomeFree Online banking services, you agree to the terms and conditions of this agreement, which may be amended occasionally.  Please keep an up to date copy of this agreement for your records.

 

In addition to this agreement, you are also bound by the terms and conditions of other agreements and disclosures that govern your deposit accounts, loan accounts, or other services and applicable State and Federal laws and regulations.
 

Before you can use HomeFree Online banking for the first time, you must agree to the terms and conditions of the online agreement.  This includes any future changes to the terms and conditions.  If you agree to the terms of this agreement you should click on the “Agree” button at the bottom of the agreement.  If you do not agree with the terms of this agreement you should click the “Do Not Agree” button and exit the site immediately.

 

Terminology

The terms “we”, “us”, “our”, and “Bank” refer to Home National Bank.  The terms “you” and “your” refer to the customer authorized to use HomeFree Online Banking.

“Business Day” refers to Monday through Friday, excluding Holidays observed by the Federal Reserve Banks.

Services Available

Home National Bank offers the following services via HomeFree Online Banking:

·         Account balance inquiry

·         Express transfer (used to transfer between Home National Bank accounts)

·         Schedule loan payments

·         Online bill payment

·         E-mail used to contact Home National Bank

Occasionally, Home National Bank may add or delete services listed above.  By using any new services that become available, you agree to the terms and conditions of those services.

Fees

There is currently no charge for the use of HomeFree Online Banking or HomeFree Bill Pay.  Home National Bank reserves the right to charge for these services at the discretion of the Bank.  We will notify our customers prior to charging for these services.

Termination

You have the right to discontinue using HomeFree Online Banking at any time.  Your access code will be deactivated after 90 days of inactivity.  We reserve the right to terminate your ability to use HomeFree Online Banking at any time, if we feel that you are not abiding by the terms and conditions of the Agreement.


User ID and Password

You may obtain a User ID and Password for HomeFree Online Banking by completing the first time user form.  For security purposes, Home National Bank will mail you the computer assigned User ID, however you will be required to visit the Racine Office to obtain your temporary password.  You will be required to change your Password the first time you log onto the system.  You may change your Password at anytime thereafter.  If you feel that your Password has been compromised please change it immediately.  You authorize Home National Bank to follow any instructions given by you through your User ID and Password.  After three failed attempts to log on, your password will be blocked for five minutes; this series of invalid attempts can be repeated three times before your Password has to be reset.  If your Password needs reset please contact Home National Bank.  You agree to hold the Bank harmless from any liability, cost, expense, or damages, which the Bank may incur as a result of acting upon instructions, or implementing transactions, which bear your User ID and Password.  You also agree that the Bank is not liable for any transfer, or transaction from or to any account where the transfer, or transaction bears the appropriate User ID and Password.  You agree that e-mail or other communications viewed or transmitted between us through the HomeFree Banking service shall be treated as a contract and shall bind each of us in the same way as written communication.  You agree that use of your User ID and/or Password to access the HomeFree Banking service through our website in connection with a communication that you send to us shall be treated as your signature.  Home National Bank is entitled to act on instructions received through HomeFree Online Banking under your Password and without inquiring into the identity of the person using said Password nor are we under any obligation to monitor transactions to determine that they are made on behalf of the account holder.  You agree to hold the bank harmless as a result of any damages you may incur as a result of it.  For your protection, do not disclose your Password by telephone to anyone claiming to represent Home National Bank.  Home National Bank employees do not need to know your Password and will not ask you to disclose it.  Home National Bank will not contact you by e-mail requesting you to update your User ID and Password.  If you choose to give your Password to someone, despite the advice of Home National Bank, you are doing so at your own risk.  Anyone to whom you give your HomeFree Online Banking password or other means of access will have full access to your accounts and transactions conducted by such persons will be considered to be authorized by you.  You must contact Home National Bank immediately if your password has been lost, stolen or otherwise compromised in any way.  Home National Bank will immediately disable your password.

System Requirements

For you to access HomeFree Online Banking you must have an Internet connection.  Home National Bank is not liable for charges incurred by you while using the Internet to visit the Home National Bank website.  You must also have an eligible account with the Bank, a properly issued and validated User ID and Password, and a secure Internet Browser.

Accessibility

You may access your accounts through HomeFree Online Banking 24 hours a day 7 days a week.  However, there may be times when HomeFree Online Banking will not be available due to system maintenance that may occur at any time without notice.  Transfers will be effective immediately if funds are available. 


Bank Liability for Failure to Make Transfers

If we do not complete a transfer to or from your account on time or in the correct amount according to this agreement with you, we will be liable only for your actual losses or damages and not consequential damages, caused by our sole negligence.  There are some exceptions to our liability.  We will not be liable for instance:

·         If, through no fault of ours, you do not have enough money in your account to make the transfer;

·         If a legal order directs us to prohibit withdrawals from the account;

·         If your account is closed or if it has been frozen;

·         If the transfer would go over the credit limit for any credit arrangement set up to cover overdrafts;

·         If you, or anyone you allow, commits any fraud or violates any law or regulation;

·         If any electronic terminal, telecommunication devise or any part of the electronic fund transfer system is not working properly;

·         If you have not properly followed the instructions for using HomeFree Online Banking;

·         If circumstances beyond our control (such as fire, flood, or improper transmission prevent the transfer, despite reasonable precautions we have taken.

Disclosure of Account Information to Third Parties

We will disclose information to third parties about your account or the transfers that you make:

·         In order to comply with government agency or court orders, subpoenas, garnishments or writs of suggestion; or

·         If you give us permission

Unauthorized Transfers

The provisions of this section that limit a consumer’s liability for unauthorized transfers pertain only to electronic funds transfers that debit or credit a consumer’s checking, savings, or other asset account that is established primarily for personal, family or household purposes, and is subject to the Federal Reserve Board’s Regulation E.  Contact Home National Bank immediately if you believe another person has improperly obtained your HomeFree Online Banking password.   Also notify the Bank is someone has transferred or may transfer money from your account without permission, or if you suspect any fraudulent activity on you account.  Telephoning is the best way to keep your possible losses down.  To notify us, call Home National Bank at (740) 949-2210; or write Home National Bank P.O.
